Conditions of Service
All accounts are worked on a contingent basis under the LaSource Corporation standard rates (20/40) unless otherwise specified. No recovery no fee. Returns of the product will be billed at 15%. Accounts placed for Immediate Debtor Contact will be handled at once by our Firm. If Free Demand Service is selected and reported paid in full before the final Due Date, there will be No Charge. On any unpaid balance, LaSource Corporation is authorized to proceed with Immediate Debtor Contact.
No account can be accepted for free demand service only. All payments, settlements, return of merchandise, or accounts were withdrawn after Immediate Debtor Service has started are subject to regular fees. Should it become necessary to forward this claim to an attorney and if counsel has not been designated by the creditor, LaSource Corporation is authorized as the Collection Agent to select and tender the account to an attorney who will at all-time be an agent of and subject to creditor’s direction and control. On all accounts forwarded to attorneys, additional fees will be due on all funds collected. LaSource Corporation shall not be responsible for acts or omissions by such attorneys. If the creditor authorizes suit and legal action is filed additional charges for legal service and advance costs in addition to LaSource Corporation regular collection fees will be required. As Collection Agent for the creditor, LaSource Corporation is authorized to endorse and negotiate or deposit in any LaSource Corporation bank account any and all checks, drafts, notes, or other forms of currency and deduct authorized charges from these payments.
LaSource Corporation will be entitled to a commission on all funds collected including pay directs, merchandise returns, accounts withdrawn from the collection, as well as when it is discovered that an account was resolved prior to placement with LaSource Corporation. It is the policy of the LaSource Corporation to refund any overpayment within a 30-day period back to the person or entity who paid the overpayment to the LaSource Corporation. Refunds will be mailed to the address we have on file at the time of the refund or refunded to the card used in the transaction. LaSource Corporation may retain all lawful sums collected in addition to the principal amount as compensation for its costs. International accounts will be subject to fees based on country of origin. The creditor shall defend, indemnify and hold harmless LaSource Corporation its employees and agents from and against all liability, suits, claims, demands, loss, actions, expense, or damages resulting from the following: any acts, claims, or omissions of any attorney relating to any account forwarded on behalf of the Creditor for collection by LaSource Corporation; the validity and accuracy of information provided by the Creditor to LaSource Corporation; the creditors claim to arise out of a non-commercial account; any amendment to the scheduled rates being provided to the creditor by LaSource Corporation.
The LaSource Corporation will exert its best effort and expertise in a fully professional manner and in accordance with all applicable laws, rules, and regulations to collect from each debtor all sums owing to the client. LaSource Corporation shall have the right to return to the client any debtor account, which it deems to be uncollectible. All collections, remittances, and other sums received by LaSource Corporation from or on behalf of any account shall be paid to the client after a 15-day hold to ensure funds clear and remitted bi-monthly on the 7th and 21st. Until such payments are made, such accounts shall be maintained in a separate trust account on the client’s behalf. LaSource Corporation shall have the right to endorse for deposit and collection, in the name of the client, all funds received from the accounts, and to deduct from such funds all commissions payable to LaSource Corporation. All remittance advice to the client, which shall accompany each such payment, shall include the debtor’s name, date of payment, and the amount collected. No return of merchandise in lieu of payment shall be accepted by LaSource Corporation without the prior oral or written consent of the client.
